Terms

What we promise, what we deliberately do not promise, and what you are responsible for. Section 3 is the one to read if you only read one.

1. Who these terms are between

These terms are an agreement between you (or the business you are buying for) and No Fear Tech Ltd, registered in England and Wales. They apply from the moment you subscribe or start using Onserva, whichever is first.

They are written for businesses. If you are buying as a consumer rather than for a business, your statutory rights are unaffected by anything here and take precedence where they conflict.

If you are agreeing on behalf of a company, you confirm you are allowed to.

2. What Onserva does

Onserva watches the servers you connect it to, tells you when something looks wrong and explains what it means in plain English, and — on the Manage plan — carries out fixes from a fixed, pre-tested list once you have authorised them. It can also build new servers to a hardened standard.

The service is delivered as software, hosted by us, with a small agent you install on each server you want watched.

What you are buying is per server, per month or per year, at the prices shown on the pricing page when you subscribe.

3. What Onserva does not promise

This section matters more than the rest of the page, so it is written plainly.

  • We do not guarantee uptime — not ours, and certainly not yours. There is no service level agreement, no uptime percentage and no credits scheme. If you need contractual uptime commitments, talk to us before subscribing rather than assuming.
  • We do not guarantee that every problem will be detected. Monitoring reports what the operating system tells it, at intervals. A fault that leaves no trace in those readings, or that occurs and resolves between them, may not raise an alert.
  • We do not guarantee that every alert is real. Thresholds are judgement calls, and a busy server sometimes looks like an unwell one.
  • We do not guarantee that a fix will work, or that it will not have consequences. Restarting a program interrupts what it serves. That is why nothing runs without you saying so.
  • The AI’s diagnosis is an opinion about a table of numbers. It is usually a good one, and it is not a substitute for your own judgement about your own systems.
  • We are not your backup, and we do not take one. If your data matters, back it up independently of us.

None of this is us being coy. A monitoring service that promised otherwise would be promising something no monitoring service can deliver.

4. Your servers remain yours

You remain responsible for your servers, for what runs on them, for their data, and for their backups. Onserva watches and assists; it does not take ownership of anything.

You are responsible for having the right to install the agent on the machines you connect, and for anything that happens as a result of a fix you authorise.

You must keep your account credentials and your authenticator app secure, and tell us promptly if you think someone else has got into your account.

You must not use Onserva to monitor machines you do not control, to attack anything, or to break the law.

5. Authorising a fix

Nothing runs on your server until you press Authorise, every single time. There is no automatic mode and no setting that switches one on.

When you authorise a fix you are instructing us to carry it out. The screen that asks you says what will happen and what it costs if it goes wrong, above the button rather than after it. Please read it.

Every authorisation is recorded in an append-only log with who approved it, when, and what the server said back. Neither of us can edit that record afterwards.

If nothing on the pre-tested list fits the problem, the answer is that it needs a person. That is a complete answer, not a failure — and it means some problems will need work from you or from us outside the automated flow.

6. Building a server for you

If you ask us to build a new server, you buy the machine from your own provider and hand us its temporary sign-in once. We destroy that credential the moment the work begins and replace the way in with key-based access under your own key.

The recipe is version-controlled and the same every time. If any safety check fails part-way it stops and leaves your original access intact rather than risking locking you out.

We do not buy servers on your behalf, and we are not responsible for your provider’s billing, availability or conduct.

7. What it costs, and when you pay

Onserva is £49 per server per month for Watch and £99 per server per month for Manage. Five servers or more is priced separately — talk to us.

You can instead pay for a year in advance, which costs ten months rather than twelve: 2 months are free.

There is a one-off setting-up fee: £75 for a server you already have, £125 for one we build from scratch. It is charged once for your account, not once per server, and it is waived entirely if you pay annually.

The setting-up fee pays for the work of learning what your servers do, what normal looks like on them, and tuning your alerts accordingly. It is not a charge for installing the agent, which takes one command and about a minute.

All prices exclude VAT, which is added where it applies. Payment is by card, in pounds sterling, in advance.

Monthly subscriptions renew every month and annual ones every year, automatically, until cancelled. We will tell you at least 30 days before any price change, and it will only ever apply from your next renewal — never mid-term.

If a payment fails we will try again and tell you. If it stays unpaid we may suspend the service after telling you first; we will not delete your data for at least 30 days after that.

8. Stopping

You can cancel at any time, and you do not have to give a reason. Write to us and we will action it.

A monthly subscription stops at the end of the month you have paid for. You keep the service until then.

An annual subscription runs to the end of the year you have paid for and then stops. Because the two free months and the waived setting-up fee are given in exchange for that commitment, an annual term paid in advance is not refunded part-way through. If you cancel in the first 14 days and we have not yet done the setting-up work, we will refund you in full.

We may end the agreement if you break these terms seriously, or use Onserva to attack or harm anything, and we will say why.

When your account closes you can ask us for a copy of your data. After 30 days it is deleted, except the billing records UK tax law requires us to keep.

9. If something goes wrong

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Those exclusions come first and override everything below.

Otherwise, and to the extent the law allows: we are not liable for loss of profit, loss of business, loss of goodwill, loss of anticipated savings, or for any indirect or consequential loss, however it arises.

Our total liability to you for everything arising out of this agreement in any twelve-month period is limited to the fees you paid us in the twelve months before the claim.

We are not liable for anything caused by your provider, your hosting, your network, your software, a fix you authorised, or a problem the monitoring did not detect — subject always to the first paragraph of this section.

You are responsible for keeping your own backups. We are not liable for data loss you could have avoided by holding one.

10. Your data

How we handle personal data is set out in the privacy policy, which forms part of these terms.

Where you use Onserva in connection with data belonging to other people, you are the controller and we act as your processor under the terms described there. We will process that data only to provide the service, and only in the ways that page describes.

You keep all rights in your own data. We claim none of it.

11. Changes

We improve Onserva continuously, and features may change. We will not remove something you rely on without telling you first.

If we change these terms we will update this page and change the date at the top. Where a change materially affects you we will email you at least 30 days beforehand, and you may cancel before it takes effect if you do not accept it.

12. The legal bits

If any part of these terms turns out to be unenforceable, the rest still applies.

Not enforcing something straight away does not mean we have given it up.

Nobody other than you and us has rights under this agreement.

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
